What Is a Whistleblower Program?

A whistleblower program is a formal, protected channel through which individuals can report concerns about serious misconduct, unethical behaviour, legal breaches, or safety risks within an organisation, without fear of penalty, retaliation, or discrimination.

At Home Care Experts, we believe that a culture of integrity starts with people feeling safe to speak up. Whether you are a staff member, a contractor, a participant, a family member, or a member of the public, if you have a genuine concern about something occurring within our organisation, we want to hear from you.

This program operates independently of our standard feedback and complaints process. It is specifically designed for matters that are serious in nature, where the person raising the concern may fear consequences for doing so, or where the conduct being reported relates to leadership, management, or systemic issues within the organisation.

All disclosures received through this program are handled with strict confidentiality, investigated thoroughly, and reported to senior leadership. Your identity will never be disclosed without your consent, except where required by law.

Legal Framework

Corporations Act 2001

Our Whistleblower Program is established in accordance with the whistleblower protection provisions under Part 9.4AAA of the Corporations Act 2001 (Cth), as strengthened by the Treasury Laws Amendment (Enhancing Whistleblower Protections) Act 2019.

Also Relevant

The NDIS Quality and Safeguards Commission Act 2017 and the NDIS Code of Conduct both require registered providers to maintain open and accountable channels for reporting misconduct and safety concerns.

Who Can Make a Disclosure?

You do not need to be an employee of Home Care Experts to use this program. The following individuals are all eligible to make a protected disclosure.

Current Employees

Any person currently employed by Home Care Experts in any role, full-time, part-time, or casual.

Former Employees

Any person who was previously employed by Home Care Experts, regardless of how long ago they left.

Contractors and Suppliers

Any contractor, subcontractor, consultant, or supplier who provides services to or on behalf of Home Care Experts.

Volunteers

Any person volunteering with or on behalf of Home Care Experts in any capacity.

Associates and Partners

Any person or organisation that has a business relationship with Home Care Experts, including referral partners and allied health providers.

Relatives and Dependants

A spouse, relative, or dependant of any of the above who has information about misconduct within the organisation.

What Can Be Disclosed?

This program is for serious concerns. The following types of conduct are appropriate to disclose through the Whistleblower Program.

Abuse, Neglect or Exploitation of Participants

Any form of physical, emotional, financial, or sexual abuse, neglect, or exploitation of NDIS participants in our care.

Fraud or Financial Misconduct

Fraudulent NDIS billing, misuse of participant funds, false claims, financial theft, or any other form of financial misconduct.

Breaches of Law or Regulation

Conduct that breaches the NDIS Act, Corporations Act, privacy legislation, workplace laws, or any other applicable Australian law.

Unsafe Work Practices or Safety Risks

Practices that put participants, staff, or members of the public at serious risk of harm or injury.

Corruption or Bribery

Any offer, acceptance, or facilitation of bribes, kickbacks, or corrupt conduct involving staff, management, or third parties.

Cover-Ups or Suppression of Information

Any deliberate concealment of incidents, falsification of records, or suppression of information to avoid accountability.

Discrimination or Serious Harassment

Systemic discrimination, bullying, or sexual harassment, particularly where it has not been addressed through normal channels.

Serious Governance Failures

Conduct by leadership or management that represents a serious failure of governance, ethical standards, or organisational accountability.

You Are Protected When You Speak Up

Anyone who makes a disclosure in good faith through this program is entitled to the following legal and organisational protections.

Identity Confidentiality

Your identity will never be revealed to anyone inside or outside the organisation without your explicit consent, except where required by law.

Protection from Retaliation

No person who makes a good faith disclosure will face dismissal, demotion, harassment, discrimination, or any other form of retaliation.

Legal Immunity

You cannot be subject to civil, criminal, or administrative liability for making a protected disclosure, provided it is made in good faith.

Timely Response

Every disclosure will be acknowledged within 2 business days and investigated within a reasonable timeframe, with updates provided where possible.

Access to Support

Whistleblowers may access independent support, including legal advice and counselling, at no cost during the disclosure and investigation process.

Right to Escalate Externally

If you are not satisfied with our response, you have the right to escalate your disclosure to ASIC, the NDIS Commission, or another relevant regulatory body.

You can report through any of the following channels. All are confidential. You may also choose to remain completely anonymous.

Anonymous Reporting

You are not required to identify yourself when making a disclosure. Anonymous reports are accepted and will be investigated to the fullest extent possible. Please note that anonymous disclosures may limit our ability to seek clarification or provide you with updates on the outcome.

How Your Disclosure Is Handled

Every disclosure is taken seriously. Here is what you can expect once you have submitted a report.

Acknowledgement Within 2 Business Days

Your disclosure will be acknowledged promptly by our Whistleblower Officer. If you have provided contact details, you will receive written confirmation that your report has been received and is under review.

Assessment and Triage

The disclosure is assessed to determine its nature and seriousness. Where immediate safety risks are identified, action will be taken without delay. The Whistleblower Officer will determine who needs to be involved in the investigation while protecting your identity.

Investigation

A thorough and impartial investigation is conducted. This may involve reviewing records, interviewing relevant parties, and engaging external investigators where necessary. The investigation will be completed as promptly as the matter allows.

Outcome and Action

Where misconduct is substantiated, appropriate action will be taken. This may include disciplinary action, referral to regulatory bodies, or notification to law enforcement. Where the disclosure is not substantiated, you will be informed of that outcome.

Reporting to the Board

All disclosures are reported in aggregate to the Board of Home Care Experts on a regular basis to ensure organisational oversight and accountability at the highest level.

False or Malicious Disclosures

Whistleblower protections apply to disclosures made in good faith. Individuals who knowingly make false, malicious, or vexatious disclosures are not protected and may face appropriate action. We encourage all disclosures to be made honestly and with genuine intent.

Reporting Externally

You always have the right to report directly to a regulatory body, either instead of or in addition to reporting internally. The following bodies accept disclosures from individuals concerned about registered NDIS providers and organisations subject to the Corporations Act.

Concerns about the conduct of NDIS registered providers, worker misconduct, and breaches of the NDIS Code of Conduct can be reported to the Commission.

Concerns about tax fraud, evasion, or related misconduct can be disclosed directly to the Australian Taxation Office.

Victoria Police

If you believe a criminal offence has been committed, you may report this directly to Victoria Police or the Australian Federal Police.
